The products marketed on the www.congtri.com website (hereinafter, the “Website”) are sold and invoiced by owned by NGUYEN CONG TRI Co. Ltd – a company having its registered offices in 194 Nguyen Dinh Chieu Street, District 3, Ho Chi Minh City, Vietnam with VAT n. 0302644297, (“CONG TRI”).

1. THE GENERAL CONDITIONS OF SALE

1.1 CONG TRI offers products on its website for individuals aged 18 or older for personal, non-commercial use (“Customer”). CONG TRI reserves the right to reject orders that do not meet these Customer requirements or fail to comply with these Terms.

1.2 An agreement between CONG TRI and the Customer is established when CONG TRI accepts an order (including partial acceptance). If the order is not accepted, CONG TRI will promptly notify the Customer. This agreement covers a single delivery of purchased products and remains in effect from purchase until delivery, as well as other rights the Customer may be entitled to (e.g., exchange rights or other legal entitlements).

1.3 By placing an order through the form on the website (“Order”), the Customer agrees to these Terms, which may be printed or saved for future reference according to applicable laws.

2. PURCHASING GUIDELINES

2.1 The products offered on the Website by CONG TRI are those displayed at the time of placing the order, accompanied by detailed descriptions. Please note that product images on the Website are for illustrative purposes only and may not fully represent all product characteristics; colors and dimensions may vary depending on the screen and device used.

2.2 The Customer may place an order by completing and submitting the order form on the Website, following the provided instructions. Before placing an order, please review these Terms, as well as product details, pricing, and shipping fees carefully.

2.3 CONG TRI will confirm receipt of the order by sending an email to the email address provided by the Customer. This email will include a summary of the order details (main product characteristics, pricing, size, payment method, and shipping fees) for the Customer to review and report any inaccuracies.

2.4 CONG TRI may not process an order if it is incomplete, incorrect, or if the product is unavailable. In such cases, CONG TRI will inform the Customer via email that the order has not been fulfilled and specify the reason. If a product is out of stock at the time of order receipt, CONG TRI will make every effort to notify the Customer of the cancellation as soon as possible.

3. PRICE AND TERMS OF PAYMENT

3.2 Payment for the product and shipping fees can be made using the methods listed on our website.

Online Payment via Onepay:

Credit/Debit Cards: The entire payment system is secured following PCI-DSS international standards, so customers can confidently pay in advance with credit or debit cards on the website. The transaction is considered successful once the Alepay payment gateway confirms a “Transaction Successful” status (subject to sufficient balance/credit limit and user verification according to the card’s usage policy).

Domestic Bank Cards (ATM): Customers may pay via domestic ATM cards issued by banks in Vietnam that are connected with the payment gateway (listed below). To use this payment method, the card must be registered for online payments.

QR Code Payment with Banking Apps or E-wallets: Customers can pay by scanning a QR code with a bank’s mobile app or an e-wallet linked with the payment gateway (listed below). To use this option, the customer’s bank account must be registered for online banking services. The transaction is confirmed successful when the system returns a “Transaction Successful” status, and CONG TRI will also send a payment confirmation email to the customer’s registered email address.

Online Payment via PayPal: Customers who choose PayPal must either register for a PayPal account that includes an international payment card or log into their existing PayPal account.

3.3 For card payments, card information (number, expiration date) is encrypted and sent directly to the payment service provider, with no third-party access. CONG TRI does not store card information in its system.

4. DELIVERY OF THE PRODUCTS AND RELEVANT EXPENSES

4.1 Shipping is available to all addresses within Vietnam and internationally. In certain cases, such as pandemics or force majeure events, delivery areas may be adjusted as per government regulations, and CONG TRI reserves the right to refuse delivery. Products are shipped to the address specified by the customer, with costs detailed on the Website. For domestic customers, CONG TRI partners with a local courier service for standard delivery. For international orders, DHL is our shipping partner.

4.2 Deliveries are conducted during business hours, Monday through Saturday, excluding public holidays. Estimated delivery times for each region will be specified by the authorized courier service. In Vietnam, delivery typically takes 1–3 days; to the Americas, 3–5 days; Asia, 2–4 days; and the Middle East, 4–7 days. Orders placed outside of business hours (6 PM–9 AM) may incur an additional day for processing. While we aim to meet these delivery estimates, actual delivery times may vary based on product availability, delivery location, and external factors beyond our control (e.g., natural disasters, transportation issues). CONG TRI is not liable for any losses, damages, penalties, or costs related to delivery delays.

4.3 To protect your rights and enhance your experience, CONG TRI encourages you to check the external condition of the package upon receipt by following these steps:

– Inspect the box/package: It should be carefully wrapped with CONG TRI-branded tape, showing no signs of damage, dents, or tears.

– If you are unsatisfied with the package’s condition, you may refuse to accept it.

– We recommend recording a video when opening the package. This documentation may assist in resolving any issues that arise later.

CONG TRI will only address complaints related to the order if the customer provides an unaltered video recording of the package opening, showing all sides with the CONG TRI tape intact and unbroken. For any issues regarding your order, please provide full order details, along with images and video of the package and product, to our support team at cs@nctgroup.vn.

4.4 Shipping fees are calculated based on the distance from our distribution center to the delivery address, as well as the product’s weight. We will inform you of available shipping options, fees, and delivery timelines when processing your order.

5. ROLES AND RESPONSIBILITIES IN LOGISTICS

This section details the responsibilities, rights, and liabilities of both CONG TRI’s logistics partners (referred to as “couriers”) and CONG TRI (referred to as “clients”). These roles are designed to ensure smooth, safe, and transparent logistics and handling processes.

Courier’s Role: Our logistics partners are responsible for transporting CONG TRI products safely and securely from our distribution center to the customer. Couriers act on behalf of CONG TRI to deliver goods with professionalism and care, ensuring that clients receive their products as expected.

Courier Obligations:

– Couriers are obligated to deliver the products to the specified location, in perfect condition, and on time. They must transport the items in original, sealed packaging, preserving the integrity of the goods from the moment they pick them up until delivery.

– Goods must be delivered only to the authorized recipient (the client or their designated representative) to ensure secure handover and avoid any risk of delivery to unauthorized parties.

– The courier is responsible for covering all transportation costs as stipulated in the logistics agreement. These may include fuel charges, labor costs, and additional handling fees unless otherwise specified in the agreement.

– If goods are lost or damaged in transit due to the courier’s actions or negligence, the courier is responsible for compensating the client for the value of the goods or providing suitable remedies.

Courier Rights:

– Couriers have the right to check and verify the authenticity of the goods, including associated documents such as bills of lading or other transport documents, to ensure accurate delivery and compliance with transportation agreements.

– Couriers may refuse to transport goods that are inconsistent with the agreed-upon product type or that do not comply with transport standards outlined in the service agreement.

– The courier has the right to demand timely payment of transportation fees as agreed upon, ensuring fair compensation for their services.

– Couriers may decline to transport items classified as prohibited, dangerous, or hazardous. This policy aims to ensure the safety of all parties involved and complies with transport regulations.

Client Responsibilities:

– Pre-packaging and Sealing: All products are carefully pre-packaged and sealed by CONG TRI to ensure secure delivery in original condition.

– Timely Payment of Fees: CONG TRI must ensure timely payment of transportation fees to the courier in accordance with the contractual terms.

– Provision of Accurate Information: To facilitate a safe and efficient delivery process, CONG TRI is responsible for providing any necessary information related to the goods being transported.

Client Rights:

– Delivery Location and Time Specifications: CONG TRI has the right to specify the delivery address and required delivery time in coordination with the courier.

– Receipt of Goods: CONG TRI, or an authorized individual, is entitled to receive the goods directly or designate a third-party representative to accept delivery.

Liability for Damages

– Courier’s Liability: The courier is responsible for compensating CONG TRI for any goods lost or damaged while in transit due to the courier’s actions or negligence. This includes cases of mismanagement, mishandling, or transit-related incidents.

– Client’s Liability: Should the goods being transported pose a danger due to hazardous materials or insufficient packaging and result in damages, CONG TRI may be liable for compensating the courier for any resulting harm, as well as for damages to third parties impacted by these goods.

– Force Majeure (Unforeseeable Circumstances): In the event of force majeure (e.g., natural disasters, political unrest) that results in the loss, damage, or destruction of goods during transit, the courier is not held liable for damages, unless an alternative arrangement is agreed upon or required by law.

6. RETURN POLICY

Customers may return items in accordance with the CONG TRI Return Policy. For details, please refer to the Return Policy section on the Website.

Other processing, if any, of such data shall be carried out only with Customer’s express consent and as permitted by applicable laws.

9. APPLICABLE LAW

The sale agreement under these Conditions and its performance are governed by Vietnamese Law, without giving effect to the conflicts of law provisions thereof or the United Nations Convention on Contracts for the International Sale of Goods.

10. AMENDMENTS AND UPDATES

10.1 The General Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new General Conditions of Sale shall be effective as of the date of publication on the Site. In any case, any purchase will be ruled by the General Conditions of Sale currently in force and accepted by the Customer at the time of the Order.
